Marathon Equipment (“Marathon Equipment,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect, how we use, share, retain and protect it, and the choices and rights you have.

It applies when you visit www.marathonequipmentus.com (the “Website”), purchase our products, submit an inquiry or quote request, sign up for emails or text messages, or otherwise communicate with us online. It does not apply to third-party websites or services that we link to or that operate independently of us.

By using the Website, you acknowledge the practices described in this Privacy Policy. If you do not agree with them, please do not use the Website.

1. Information We Collect

We collect the following categories of personal information in the course of operating the Website. We collected each category during the past 12 months.

Information you give us. This includes your name; email, mailing, billing and shipping address; telephone number; company name; order and purchase history; product preferences and inquiries; the contents of contact forms, quote requests, emails, text messages and customer-service conversations; and anything else you choose to provide.

Order and payment information. When you place an order, we collect the details needed to process and deliver it, such as your name, addresses, email, telephone number, items ordered and transaction details. Payments are handled by third-party payment processors (see Section 4). We do not store full payment card numbers on our servers.

Information collected automatically. When you use the Website, cookies, server logs and similar technologies collect your IP address, browser type and version, device type, operating system, language, referring page, pages and products viewed, links and buttons clicked, shopping cart and checkout activity, approximate location (derived from your IP address), date and time of visits, time spent on pages, and other technical or usage data.

Sensitive personal information. We do not intentionally collect sensitive personal information such as government identifiers, financial account numbers, health information or precise geolocation. We do not use or disclose any sensitive personal information to infer characteristics about you. Please do not send us sensitive personal information through the Website or by email.

Sources. We collect personal information directly from you, automatically from your browser or device, and from service providers that help us operate the Website (for example, our payment processors, shipping carriers and analytics provider).

2. How We Use Your Information

We use personal information for the following business purposes:

  • Processing and fulfilling orders, processing payments, and arranging shipping and delivery
  • Maintaining business and financial records
  • Responding to inquiries and providing customer service
  • Sending order, shipping and other transactional messages by email and text
  • Sending promotional emails where the law allows and you have given any required consent
  • Providing product information and recommendations
  • Understanding how visitors use the Website, measuring performance and marketing effectiveness, and improving the Website, our products and our services
  • Detecting, preventing and investigating fraud, spam, abuse and security incidents, and troubleshooting technical problems
  • Complying with laws, regulations, court orders and legal process, and establishing, exercising or defending legal claims

We do not use your personal information for purposes that are materially different from these without telling you first and, where required, obtaining your consent.

3. How We Share Your Information

We share personal information only when reasonably necessary to run our business, and we require our service providers to use it only to perform services for us.

Service providers. These include website hosting, WooCommerce and e-commerce providers, payment processors, shipping and delivery carriers, email and SMS providers, analytics (Google Analytics), security, fraud-prevention and spam-prevention providers (including Google reCAPTCHA), IT and customer-service providers, and professional advisors.

Legal and safety reasons. We may disclose personal information to comply with law or respond to subpoenas, warrants, court orders and other legal process; to protect the rights, property or safety of Marathon Equipment, our customers or others; to investigate fraud, security incidents or unlawful activity; and to enforce our agreements and policies.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy or similar transaction, personal information may be transferred as part of it, subject to applicable law. We will give notice if the new owner materially changes how your personal information is used.

4. Third-Party Services on Our Website

WooCommerce. Our online store runs on WooCommerce, an e-commerce platform that works with our website hosting. It handles the information needed to create your order, calculate shipping and taxes, and send order communications. This can include your name, billing and shipping details, email address, telephone number, products purchased and order history. Extensions and services connected to our store may process information under their own terms and privacy policies.

Payment processors. Payments are processed by third-party payment processors. Depending on the payment method, the processor collects your name, billing address, card or bank details and other information needed to complete the transaction, and may do so directly rather than through our servers. We do not store full card numbers. Each processor’s own privacy policy governs how it handles your payment information, and we encourage you to review it before paying.

Google Analytics. We use Google Analytics to understand how visitors use the Website, measure engagement, find technical or usability problems, and improve our Website and services. Google Analytics collects browser and device information, approximate location, usage and interaction data, and identifiers associated with your browser or device, and uses cookies or similar technologies to do so. We configure our analytics so that we do not intentionally send Google information that directly identifies you, such as your email address or telephone number. You can learn how Google uses data from sites that use its services at policies.google.com/technologies/partner-sites, and you can prevent your data from being used by Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

Google reCAPTCHA. We use Google reCAPTCHA on our forms and checkout to protect the Website from spam, abuse and automated submissions. reCAPTCHA collects hardware and software information, such as device and application data, and the results of integrity checks, and sends it to Google for analysis. It may also use cookies or similar technologies. Your use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service.

5. Cookies and Similar Technologies

Cookies are small files stored on your device that help websites remember information and recognize returning visitors. We use cookies and similar technologies to:

  • Operate and secure the Website, including shopping cart, checkout and fraud prevention
  • Remember your Website preferences
  • Measure Website usage and performance through analytics
  • Support our communications and marketing, where applicable

Some cookies are strictly necessary for the Website to work and cannot be turned off in our settings. You can control other cookies through your browser settings. We do not currently offer a separate cookie-consent tool. Blocking cookies may affect features such as the shopping cart and checkout.

6. Email and Text Message Communications

Email. We may email you order confirmations, shipping updates, responses to your inquiries, service announcements, product information, newsletters and promotions. You can unsubscribe from promotional emails at any time using the link in the email. We may still send transactional or service messages needed to complete an order, provide a requested service or share important information.

Text messages. We do not send marketing or promotional text messages. If you text us, for example to ask about a product, a quote or an order, we use your mobile number and the content of your message to reply and provide customer service. Message frequency depends on your conversation with us. Message and data rates may apply. Reply STOP at any time to stop receiving texts from us, or HELP for help.

We send text messages using Nextiva, a third-party communications provider. Nextiva processes your phone number, message content and related technical data on our behalf, and its own terms and privacy policy also apply. We keep text conversations as customer-service records for the period described in Section 8. No mobile information is shared with third parties or affiliates for their marketing or promotional purposes. Your mobile number and text messages are not shared with third parties other than Nextiva, which acts on our behalf, except as described in Section 3.

7. Sale, Sharing and Targeted Advertising

In the past 12 months, we have not sold personal information for money or other valuable consideration, and we have not shared personal information for cross-context behavioral advertising (targeted advertising). We do not knowingly sell or share the personal information of anyone under 16.

The Website does not use advertising or remarketing tools or tracking pixels.

If this changes, we will update this Privacy Policy and give you the opt-out choices required by law before the change takes effect.

8. Data Retention

We keep personal information only as long as needed for the purposes in this Privacy Policy, and we do not keep it indefinitely simply because it was collected. The periods below are the maximum we generally keep each type, unless the law requires or permits a longer period (for example, for a legal hold, tax audit or dispute).

We also keep limited information about former customers when reasonably necessary for accounting, tax, legal, fraud-prevention, warranty and dispute-resolution purposes. When we no longer need personal information, we delete it or de-identify it.

9. Security

We use reasonable administrative, technical and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration and disclosure. These include HTTPS/TLS encryption for data sent between your browser and the Website, access controls, authentication, security monitoring, software updates and backups.

No website, transmission or storage system is completely secure, so we cannot guarantee absolute security. Please avoid sending sensitive information through unsecured channels such as ordinary email.

10. Your Privacy Rights

Depending on where you live, and subject to legal exceptions, you may have the following rights. We offer these rights to California residents and to residents of other U.S. states whose laws provide them.

  • Know and access. Confirm whether we process your personal information, and receive the categories collected, their sources, our purposes, the categories of recipients, and a copy of the specific pieces we hold about you.
  • Correct. Ask us to fix inaccurate personal information.
  • Delete. Ask us to delete personal information we collected from you.
  • Portability. Receive your personal information in a portable, readily usable format.
  • Opt out. Opt out of the sale or sharing of personal information, and of targeted advertising. As described in Section 7, we do not currently engage in these activities.
  • Limit sensitive information. We do not collect sensitive personal information, so there is nothing to limit.
  • Marketing choices. Unsubscribe from marketing emails at any time, or reply STOP to our texts (Section 6).
  • No retaliation. We will not deny you service, charge different prices, or provide a different quality of service because you exercised a privacy right.

We may deny or limit a request where the law allows, for example when we must keep information to complete a transaction, comply with a legal obligation, detect or prevent fraud, protect security, or establish or defend legal claims. If we do, we will tell you why.

California residents. California law gives you the rights listed above. Under California’s “Shine the Light” law, California residents may also ask which categories of personal information we disclosed to third parties for their direct marketing. We do not disclose personal information to third parties for their own direct marketing purposes.

11. How to Submit a Request

To exercise a privacy right, contact us by any of these methods:

Verification. We must confirm that a request comes from you before acting on it. We will ask for enough information to match your request to our records, such as your name, email address and a recent order number. We will not ask for more than we need.

Authorized agents. You may use an authorized agent to submit a request for you. We may ask for written proof of the agent’s authority and may confirm your identity with you directly.

Timing. We will confirm receipt within 10 business days and respond within 45 days. If we need more time, we may extend that period once by up to 45 more days and will tell you why.

Appeals. If we deny your request, you may appeal by replying to our response or by contacting us at the email above with “Appeal” in the subject line. We will respond in writing within 45 days (60 days where state law allows) and, if we deny the appeal, explain how to contact your state attorney general.

12. Opt-Out Preference Signals and Do Not Track

We treat a browser-based opt-out preference signal that is legally recognized in your state, such as the Global Privacy Control (GPC), as a valid request to opt out of the sale or sharing of personal information for that browser. Because we do not currently sell or share personal information, the signal does not change how we handle your data.

There is no universal standard for “Do Not Track” browser settings, so the Website does not respond to them.

13. Children’s Privacy

The Website is intended for businesses and adults and is not directed to children under 16. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 16. If you believe a child has given us personal information, contact us and we will take reasonable steps to delete it.

14. Third-Party Websites and International Visitors

Third-party sites. The Website may link to or embed third-party websites, social media platforms and other services. We do not control and are not responsible for their privacy practices, security or content. Embedded third-party content may also collect information about your interaction with it. Their terms and privacy policies govern your use of them.

International visitors. The Website is operated from the United States for customers in the United States and the Caribbean region. If you access it from another country, your information will be transferred to, stored in and processed in the United States, where privacy laws may differ from those in your country. If the laws that apply to you give you additional rights, we will honor them to the extent required.

15. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our business, the Website, our technology, our service providers or the law. We will post the updated version here and change the “Last Updated” date. If we make material changes, we will provide additional notice where appropriate or required by law, such as a notice on the Website or an email. Please review this page periodically.
